The Brazil online betting ban is six weeks old, and the thing most coverage still gets wrong is its legal status: it is not a law. Provisional Measure 1,394 was signed on 25 September 2026, published in an extra edition of the Diário Oficial da União and took effect the same day, but a provisional measure in Brazil is a temporary instrument that expires unless Congress converts it. The betting sites are already gone. The statute behind them is not settled.
What MP 1,394 actually prohibits
The measure is broader than the phrase “betting ban” suggests. It prohibits operating, offering, intermediating and advertising fixed-odds betting in Brazil, whether delivered online or physically, and it reaches operators based abroad that serve Brazilian players. Crucially for anyone who followed the 2023 regulation, it does not stop at sport:
- Fixed-odds sports betting — the core of the regulated market created by Law 14.790/2023.
- Online games of chance — which is to say online casino, including slots, in the same stroke.
- Intermediation — not just running a book but standing between player and operator.
- Advertising, marketing and sponsorship — in any physical or digital medium.
- Offshore operators — being licensed elsewhere is not a defence.
Other lottery products authorised under separate legislation are not affected, which is why the federal lotteries continued without interruption. The distinction the measure draws is not between online and retail, or between domestic and foreign. It is between fixed-odds betting and everything else.
The eleven-day shutdown, and how player balances came back
What makes this unusual among gambling crackdowns is that the money was handled first and the shutdown second. The government published a calendar with the measure, and it ran like this:
- Until 23:59 on 5 October — players could withdraw their own balances voluntarily, through the operator, as normal.
- 6 October — sites and apps had to go offline, ten days after publication, including their app-store listings.
- 7–8 October — operators had to hand the banks the amounts still sitting in player accounts, each figure tied to the individual bettor’s CPF taxpayer number.
- 9–14 October — the banks that processed the operators’ payments refunded those remaining balances directly.
- From 14 October — Caixa Econômica Federal could step in to facilitate payment where the process had failed.
Routing refunds through the payment institutions rather than the operators is the detail worth noticing. It meant a player did not have to trust a company that had just been shut down to send their money back, and it gave the state a record of who held what. Brazil’s government news agency published the refund schedule alongside the announcement, which you can read on Agência Brasil.
Why the licences ended on 25 October
Article 4 of the measure ended authorisations granted under Law 14.790/2023 thirty days after publication, which fell on 25 October 2026. Operators had paid 30 million reais for those five-year authorisations roughly a year earlier. The measure states the fee is not refunded and no compensation is due, and reports in late October put the number of sports-betting licences formally revoked at 85.
A licence that cost thirty million reais and lasted about a year is the clearest signal in the whole measure: this was not framed as a pause for consultation.
Alongside the measure the government announced a separate bill — a bill, not law — creating criminal penalties. The proposed terms are four to six years for operating fixed-odds betting, and two to four years each for promoting betting or recruiting bettors, using personal data for betting, facilitating the financial side, and providing the internet application itself. None of that is in force; it is a proposal attached to the announcement.
The deadline that matters: sixty days, and no vote yet
Article 62 of Brazil’s constitution gives a provisional measure sixty days, extendable once by a further sixty, and the clock stops during congressional recess. If Congress rejects it, or simply lets it lapse, it loses effect from the beginning rather than from the day it fails — which would leave a genuine legal mess over a market that has already been dismantled, refunded and delicensed.
Industry bodies have not waited. The National Association of Games and Lotteries and the Brazilian Institute for Responsible Gaming asked the Supreme Federal Court to suspend the measure on 28 September, three days after it was signed. On the other side, a Senate public consultation drew around 480,000 responses backing the ban. Neither of those decides anything, but together they explain why nobody in the sector is treating the outcome as settled.
What the betting ban does not cover
The measure is built around a wager: money staked on an uncertain outcome, with a payout attached. That framing is what defines its edges, and it is worth being precise about them rather than guessing:
- Lotteries authorised under other laws continued operating throughout.
- Land-based casino gaming remains prohibited in Brazil under much older legislation, so there is no retail alternative that the measure pushed players towards.
- Free-play and demo versions of slot games involve no stake and pay no prize, so they sit outside the definition of a wager the measure is built on — but local rules are for local readers to confirm, and nothing here is legal advice.
That last point is the one we can speak to directly, because it is what this site does. Every one of the free slot demos in our library runs on the studio’s own software with no deposit, no balance and no cash-out. There is no wager to prohibit, which is a different proposition from a betting site, not a workaround for one.
Brazil’s illegal market is the open question
The strongest argument against the measure is not about revenue, it is about displacement. The National Association of Games and Lotteries has warned that removing a licensed, taxed, age-verified market does not remove demand, and that what replaces it answers to nobody. The government’s own enforcement package implicitly concedes the risk: it funds takedowns of illegal sites, freezing of bank accounts used for gambling, information sharing between agencies, and extra resources for the Ministry of Justice and the Federal Police.
The sponsorship collapse gives a sense of the scale involved. Brazilian football had become heavily dependent on betting money, and estimates put the sponsorship value wiped out at around 200 million dollars. Shirt deals, stadium naming and broadcast inventory all had to be unwound inside weeks.
What this means if you play online slots
For readers outside Brazil, the practical significance is precedent. This is the first time a large, newly regulated market has been closed wholesale rather than tightened, and it happened roughly two years after that market was created. Operators spent heavily to enter it. The rules that governed it were replaced by a measure written in a single day.
For readers in Brazil, the honest summary is that the licensed market is gone, the balances were returned through the banks, the criminal penalties are proposed rather than enacted, and the measure itself still needs a vote. Anyone who held an account should confirm their refund arrived rather than assume it did, because the process ran through payment institutions on a fixed fourteen-day window and exceptions were handled individually afterwards.
We will update this piece when Congress votes or the Supreme Federal Court rules, because either one changes the answer. In the meantime, the slot games themselves have not gone anywhere: the studios that supplied the Brazilian market still build the same titles, and you can still see exactly how they behave in a free demo without a stake attached. If you want to know what we check before a game gets written up here, that is set out in how we rate games.
